My generous nature has now gotten me in big trouble and I'm more upset than I can say in words.
In my post where I posted 2 Jensen videos, I have now been notified about my unauthorized uploading of a copyrighted video. This is for the Jensen Leaving Comic Con 2008.avi. Apparently that video was originally posted by
deansdemongirl and she's now going after me for uploading the video to SendSpace (where it has now been deleted).
I found my inbox flooded with messages from her. It started with this comment to my post:
Subject: DMCA filed
I filed a DMCA with Sendspace for your unauthorized uploading of my copyrighted video from the site where I have it originally hosted. The file has been removed.
This is the message I received from Sendspace
"sendspace.com is commited to ensuring users comply with our terms of service, which state, in part, 'sendspace services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation, including export control laws, is prohibited. This includes, without limitation, material protected by patent, copyright, trademark, service mark, trade secret or other intellectual property rights.'

Any Icons artwork or redistribution of my copyrighted video will be met with further filings of DMCA.
You can view this video at the site where I posted it. There is no need to steal it from me and take away monetary gain that I was hoping to make from this video to pay for the high cost of recent medical bills.
I will be contacting you privately to discuss reimbursement for the money lost due to the theft and unauthorized use/distribution of my copyrighted material
Naturally, she doesn't come to me to simply ask that I remove the video....she goes for the jugular and attacks. I tried, through several comms, to find where I'd even gotten the download of the video myself. Now I know why I couldn't track down the original post. No doubt that person has gotten this same treatment. As I recall, it was posted on
dean_sam and the person was asking for some caps to be made of the video that she came across online. She then provided a download of the video, which I grabbed. Why am I being punished for the actions of someone else?
She then edited her comment. The first part in quotation marks is part of my original text from the post where I tried to explain that I didn't know where the video had come from.
"I can't track down the person who posted this first video. I tried searching back through my flist, but no luck. If someone knows who posted it (and the original link where the video came from), please let me know and I'll credit."
You can't find it or give them credit for it because I filed a DMCA with sendspace to have the unautuhorized distribution of my copyrighted material removed. I have done the same with your unauthorized distribution and the file has been removed.
Judging by your posting, I honestly think you didn't realize that my video had been copied without permission. I do appreciate that you wanted to give credit to me from the original site where I uploaded my video, but giving credit does not make up for unauthorized use of my material and unauthorized distribution of it.

I didn't realize her video had been copied without permission. How could I? How many videos are posted on LJ in this fandom every day? Nobody says a peep about unauthorized distribution. Yet she wants me to pay her $100.

I....I'm just incredulous over this. I understand how one can feel when their own work is stolen from them, but her actions seem extreme to me. Based on the DMCA from SendSpace mentioned above, it sounds like if anyone makes icons, artwork or further distribution of the video, I'll have to continue to reimburse her. So, please! If you downloaded that Jensen video from me, please do not re-post it, make caps or any fanart from it!
I would have gladly deleted the file from SendSpace myself if she had simply told me the video was hers and she didn't want it distributed. And I'd really like to know if the original poster of the video is being charged as well, because if it's just me, I feel unjustly persecuted because of the actions of another.
I suppose my only course of action is to pay the $100. If I don't, who knows what she'll do next.
I'm heartsick over this. Truly. LJ has always been this little community where we share things so freely with each other and to have this happen....it makes me want to stop posting things completely. I can't afford to keep shelling out money to everyone who says I'm violating their property.
